- Embezzlement by bank officer or employee: Can lead to fines up to $1 million and up to 30 years in prison. If the amount embezzled was fewer than $1,000 the person should only be fined or imprisoned less than one year.
- Embezzlement from employee benefit plan: Person may face fines and up to 5 years in federal prison.
- Embezzlement from employment and training funds: Person may face fines and up to 2 years in prison.
- Embezzlement in connection with health care: Person can be fined and face up to 10 years in federal prison.
An Embezzlement crime can also become a federal crime if any government agency is involved. An embezzlement charge can also be a Florida state crime, and can involve non-public officials such as employees stealing (embezzling) from their employer.
Judges consider the amount of money embezzled, the time period it occurred, the financial harm to the victim, and if the defendant has prior embezzlement charges when they consider the type of consequence someone should face.
If you are found guilty of embezzlement in the state of Florida the above will be taken into consideration and you can face the following consequences:
- Second-Degree Misdemeanor if property was less than $100 & is punishable up to 60 days in jail and/or a fine of $500
- First-Degree misdemeanor if the property taken is worth $300 or more but less than $20,000. Punishable up to 60 days in jail and/or a fine of $500.
- Third-Degree Felony if property taken is with $100 or more but less than $300 is punishable up to 5 years in prison and/or a fine of $5,000.
- Second-Degree Felony if property is $20,000 or above but less than $100,000 is punishable up to 15 years in prison and/or $10,000 fine.
- First-Degree Felony if the property taken is worth $100,000 or more. Punishable up 30 years in prison and/or a fine of $10,000.
