Oxycodone trafficking penalties in the state of Florida (this is if you’re charged with a state, not federal, oxy trafficking crime):
- Having less than 6.5 grams of oxycodone in your possession means you will most likely be charged with oxycodone possession rather than trafficking.
- Being in possession of 7-14 grams of oxycodone means you are looking at a state minimum mandatory prison sentence of 3 years and a possible fines up to $50,000.
- Being caught with 14 to 25 grams of oxycodone means you are facing possible fines up to $100,000 and a minimum of 7 years in state prison.
- If you are caught with anywhere from 25 to 100 grams of oxycodone, you are looking at a mandatory minimum prison sentence of at least 15 years and possible fines of up to $500,000.
- If you’ve been charged with possessing more than 100g of oxycodone (but less than 30 kilograms), you’re facing a mandatory minimum of 25 years in prison and may face fines as high as $750,000.
- Sentencing time can vary depending on if you had minimal or large involvement in the oxycodone trafficking and based on if you were armed with a weapon.
- The average guideline minimum for oxy trafficking was 76 months in 2018
- As of 2019, the average sentence for oxycodone trafficking was 50 months, meaning you could be looking at more than 50 months
