What is a Federal Oxycodone Trafficking Crime? 

Federal Oxycodone trafficking is a federal drug trafficking crime when someone deals with oxycodone, an addictive substance. This could include trading, selling, or being in possession of high amounts of oxycodone. In fact, even if you possessed a large amount of oxycodone but had no intention of selling it – you can still face an oxycodone trafficking charge because the charge has more to do with the amount of oxy in your possession and less to do with your “intent.”

Nearly 20,000 federal drug trafficking cases were reported to the United States Sentencing Commission in 2019. About 2% of those drug trafficking cases involved Oxy – that’s about 420 Federal Oxycodone Trafficking cases.

Federally speaking, an oxycodone trafficking crime becomes a federal crime when the drugs are moved across state lines or more than one state is somehow involved in the trafficking crime.

Federal oxycodone trafficking crimes are sometimes judged based on the purity of the drug. The more pure a drug is, the more likely that you face harsher punishments.

CONSEQUENCES OF FEDERAL OXYCODONE TRAFFICKING

Federal oxycodone trafficking can have serious repercussions in South Florida. This charge should not be taken lightly as you could be facing large fines and dozens of years in prison.

If you’re facing federal oxycodone trafficking charges, be aware that possessing a weapon or if you’re alleged to have had a leadership or supervisory role in the trafficking can result in increased penalties and tougher federal prison sentences. 

The good news about federal oxycodone trafficking charges is there is no mandatory minimum prison sentence. On average, federal oxycodone trafficking convicted offenders spend about 45 months (3.75 years) in prison. Of all federal oxycodone trafficking convictions about 85% of offenders were sentenced to prison in 2019 – which means about 15% did not face prison time. 

Federal consequences vary depending on how many grams of oxycodone you were in possession of. 

According to the United States Sentencing Commission, these are average consequences and penalties for federal Oxycodone Trafficking:

  • The average sentence for oxycodone trafficking offenders was 45 months in federal prison in 2019. 
    • Most people (about 70%) who are convicted of federal oxy trafficking serve 5 years or less in federal prison. 
    • Almost 20%  of people serve 5 to 10 years in federal prison.
    • Close to 10% of convicted offenders face 10 or more years in federal prison.
  • Of all  oxycodone trafficking offenders, 84.5% were sentenced to federal prison. 
  • There is no mandatory minimum penalty for oxycodone trafficking. 

Oxycodone trafficking penalties in the state of Florida (this is if you’re charged with a state, not federal, oxy trafficking crime):

  • Having less than 6.5 grams of oxycodone in your possession means you will most likely be charged with oxycodone possession rather than trafficking.
  • Being in possession of 7-14 grams of oxycodone means you are looking at a state minimum mandatory prison sentence of 3 years and a possible fines up to $50,000.
  • Being caught with 14 to 25 grams of oxycodone means you are facing possible fines up to $100,000 and a minimum of 7 years in state prison.
  • If you are caught with anywhere from 25 to 100 grams of oxycodone, you are looking at a mandatory minimum prison sentence of at least 15 years and possible fines of up to $500,000.
  • If you’ve been charged with possessing more than 100g of oxycodone (but less than 30 kilograms), you’re facing a mandatory minimum of 25 years in prison and may face fines as high as $750,000. 
  • Sentencing time can vary depending on if you had minimal or large involvement in the oxycodone trafficking and based on if you were armed with a weapon.
  • The average guideline minimum for oxy trafficking was 76 months in 2018
  • As of 2019, the average sentence for oxycodone trafficking was 50 months, meaning you could be looking at more than 50 months
