Jokaim D. was at his friend's house for a political gathering one night in Miami, Florida. On his way home from the event he was pulled over by a police officer for speeding and then arrested for DUI. Unfortunately for Jokaim, he was looking at his 3rd DUI in 10 years, which can have very bad consequences.

Strategy of Attack on Driving Under the Influence Case:

We did a thorough investigation of the cop stop and took depositions of the officers involved. We found that the investigation done was terrible, and that there were many inconsistencies with the officer's accounts. There was also no video footage. The police report provided no details suggesting that Jokaim had done anything to suggest he was impaired. Jokaim had dropped his friend off five minutes before being pulled over. His friend testified that in no way was Jokaim drunk, that he had only one glass of wine at the gathering. The prosecutors tried to argue that Jokaim had refused the breath test (which they consider a concession of guilt) but nowhere in the police report did it say that he refused to blow. Jokaim also told the cops that he was unable to do the field sobriety tests because of a leg injury he had from being shot in the leg. We had him show the jury his injury at trial and walk for them.
