It had been raining outside and the roads were slippery, and Jessica’s car spun out of control hitting another car. Jessica freaked out and tried driving away when she hit a second car. Jessica did this two more times, hitting four cars in total, before spinning into a pole. The police arrived immediately at the scene but did not complete a DUI investigation. Instead, they arrested Jessica for the four hit and runs and took her to the station. At the police station, the cops decide to complete a DUI investigation, but Jessica refused both the field sobriety exercises and breath test. Jessica was then additionally charged with Driving Under the Influence.

At the formal review hearing, we were able to get the body camera videos from the officers at the incident. On video, Jessica sounds nervous and scared, not drunk. Jessica is also not slurring her words as the cops said that she did. There was also another person in the car with Jessica, who said that she was not drunk. Because of the multiple inconsistencies we found with the officers, we were able to win the DUI hearing thereby getting Jessica her driver's license back. At first, the prosecutors wanted Jessica to spend 30 days in jail for her first offense, but we fought aggressively against their recommendation. We were granted depositions for the officers and found more issues with their statements.
