Location: Broward County
Charge Type: DUI
Result: Not Guilty
The Situation
Our client’s field sobriety test was conducted entirely in Spanish, but the state failed to provide an independent translation—a critical legal requirement in Florida. Without a certified translation, statements made during the test could not be legally admitted as evidence.
The Defense Strategy
Recognizing this major legal oversight, our attorneys immediately filed a motion in limine—a strategic move that many defense attorneys might overlook. This motion successfully prevented the state from using our client’s statements against him in court.
In addition:
- The judge ruled that all verbal exchanges from the field sobriety test were inadmissible.
- The prosecution was allowed to show video evidence but WITHOUT audio.
As a result, the jury could see the client moving but had no context for what he was being told to do—making it impossible to determine whether he was truly impaired or simply confused.
The Result
With key evidence excluded, the prosecution’s case fell apart. The jury had no choice but to return a Not Guilty verdict.
