Outcome of Florida Driving Under the Influence Case:
We were able to get Roman’s case dismissed and are now working on expunging his record.
Roman was worried about losing his driver’s license and about having a DUI conviction on his record.
Roman K. was driving home on Collins Avenue one Saturday night in Sunny Isles Beach when a cop started following him. Eventually the cop pulled Roman over and arrested him for DUI. In the incident report the cop claimed that Roman had been jerking from lane to lane, stopped 100 feet from a traffic light and took 3 blocks to pull over when the cop put his lights on. But Roman had a GoPro camera in the car that recorded his driving the entire time the cop was following him, and none of what the cop claimed in the incident report was true. In fact, another car in front of Roman’s made an illegal left turn through a solid red light and the cop ignored it because he was so focused on going after Roman.
Using the footage from the GoPro camera we tried to get the prosecution to drop the case altogether, but when the prosecution refused our new strategy was to prove the cop was lying. We conducted a heated cross examination of the officer that left the judge furious with the prosecution for putting him on the stand knowing he was blatantly lying.
