We got the prosecution to reduce the charges to reckless driving, and although we were confident we had a strong case for trial, Deborah preferred to take the reduced charges rather than go to trial.
Deborah had an excellent reputation in the community and was afraid of it being tarnished by a DUI conviction. She was also afraid of having to go to jail.
Deborah G. was coming from dinner with her friends where she had a glass of wine. She went back to the barn where she worked, had half a beer, and then went to go to Dairy Queen. She got lost along the way, and ended up hitting a parked car by accident with her truck in a very dark parking lot in Coconut Creek, Florida. There was a cop already there looking for a lost purse, and when he saw what happened he ran over and started banging on Deborah’s window and screaming at her. Deborah, a 65 year old woman, didn’t know he was a cop, was terrified and started driving. When she finally stopped he pulled her out of the car and claimed she was slurring and unbalanced. He called for a DUI cop who did an investigation on camera. Deborah refused the field sobriety tests because her husband had always advised her to. She was arrested for DUI.
Video footage by the DUI cop contradicted the claims of the first cop, so we went after him hard in depositions and got him to admit that he never identified himself as a cop when he was banging like a madman on Deborah’s car, which is why she got scared and kept driving.
