Angie A. was driving home to Pompano Beach from dinner with the girls in Delray Beach one night in her boyfriend’s expensive sports car. She really had to pee and was trying to get home quickly. Angie made a left turn, cutting in front of two cars and ended up crashing into them. The cops showed up, were rude to her and blamed her for the accident without asking her any questions about what happened. Angie explained to them that she really had to pee and that her house was right across the street, but the cops refused to let her relieve herself. As the minutes passed, finally Angie couldn’t hold it in any longer and popped a squat in the street. The cops then began a DUI investigation (even though she hadn’t stumbled or fallen over while peeing). Angie refused both the breath test and field exercises and was arrested for DUI.
Angie’s arrest was captured on the cops’ body cameras. On camera it was obvious that she wasn’t drunk. She wasn’t slurring or combative with the officers. She was mentally aware, asked thoughtful questions, and explained why she did and what she did. We also took depositions and aggressively attacked the officers’ opinions that Angie was drunk.
