Because the prosecution wouldn’t agree to drop the case altogether, we forced it to trial. We knew that without the girlfriend as a witness, the prosecution had no case. The day of trial the girlfriend still refused to cooperate with the prosecution and so they dropped the case.
Robert was afraid of going to jail, and of not being able to see his girlfriend.
Robert S. and his girlfriend were having a heated argument one night at their home in Davie, Florida. She was holding a can of pepper spray and threatening to call the police. Robert was angry that she had pepper spray and grabbed it out of her hand. He ended up spraying himself in the face, and her as well. The police were called, and Robert was arrested on charges of domestic battery.
Robert and his girlfriend originally tried to handle the case themselves as this was just a fight that got out of control. However the prosecutors refused to drop the charges and so Robert and his girlfriend hired our firm to defend him. Because she did not want to press charges we tried to reason with the prosecutors and get them to drop the case.
