Outcome of South Florida Theft Case:
After six months of fighting we were finally able to get Gene into the diversion program. After completion of the program all of the charges against him were dismissed, and he is now a college coach.
Gene was a good person who had no negative intent. He was worried about losing his job, ruining his reputation within the community, and no longer being able to coach his players.
Gene D. was a local high school coach who also worked in loss prevention at Ross. He got caught swapping out Nike sneakers and giving them to the underprivileged kids he coached (like a modern day Robin Hood). Gene, and one of the kids who was helping him were both arrested on theft charges.
Gene was 40 years old and had never been arrested before. We fought hard to get him into a theft diversion program. The prosecutor did not want to let him in because he claimed it was a scheme, and not an impulsive theft. We took depositions, showed there was missing video footage, and proved that the way the cops got Gene’s confession violated his rights.
