At trial we successfully proved that Nya was not fleeing and eluding the officer. The jury returned a not guilty verdict and even came over to hug Nya in apology after the trial was over.
Nya was facing up to 15 years in prison if convicted. Nya has had bad experiences with the cops in the past and was terrified of the arresting trooper.
Nya L. was driving on the Florida Turnpike one afternoon going 75 miles per hour. An FHP trooper was driving behind her, pace clocking her. The trooper knew she was speeding, but deliberately waited until right before the toll plaza where the speed limit abruptly drops to 55 miles per hour before pulling her over. The trooper put her sirens on, but there was nowhere safe for Nya to pull over right after the toll plaza. When Nya doesn’t pull over right away, the cop drives up alongside the driver’s side and starts screaming at Nya through the window. She screamed, “F**king b*tch, pull over!” Nya has had bad experiences with the cops in the past and is terrified of this trooper. Finally, Nya stops at the light on Atlantic boulevard in Pompano Beach, Florida. The trooper pulls up right behind her, gets out of the car and runs over yelling and screaming again at Nya. Again Nya is scared and starts moving when the light turns green. The trooper jumps on the hood of the car to stop her. Nya immediately stops the car, and the trooper rolls off the hood when she does. The trooper then handcuffs Nya and throws her on the ground calling her a hoe. Nya apologized, but that did not deter the trooper. She arrested Nya on charges of aggravated battery on a cop, fleeing and eluding.
There were a lot of misunderstandings and intimidation in this case. Yes she did some things wrong, but she didn’t commit a felony. Nya was terrified of the trooper. When we deposed the trooper, she admitted that originally when she first targeted Nya she was only going 75 mph in a 65 mph zone, which the trooper agreed was not a big deal. We also found out that a man two cars back at the light at Atlantic blvd had called 911 because he didn’t know what was happening. The man admitted that two cars back with his windows up he could still hear the cop yelling at Nya because she was that loud.
