We managed to get all of the charges dismissed.
Iracema had only recently arrived in the country and barely spoke English. She was going through the immigration process and was terrified of being deported. She had never been arrested before and was afraid of going to jail over a misunderstanding.
Iracema was waiting in line to pay at Kohl’s in Coral Springs, Florida when the lady in front of her left behind one of the bags of items she had paid for. Iracema saw that this lady had left the bag and so she picked it up and carried it out of the store to give it back to her. The store security guard saw Iracema take the bag and thought she was stealing it. He went up to her, accused her of shoplifting, and interrogated her. Iracema barely spoke English and couldn’t answer the security guard well. She ended up having a panic attack and was taken to the hospital.
Strategy of Attack on Florida Shoplifting Case:
We requested the surveillance tape from Kohl’s and it proved that Iracema was telling the truth. Once we presented this evidence to the prosecutor they agreed to drop all charges.
