Our client was charged with violating the probation he was placed on for previously being charged with sexual battery and kidnapping in South Florida 10 years ago. Violations of probation are very serious, and can result in the defendant being sent to prison for the maximum sentence for the original crime.
We were hired and got to work on Walter’s case. We got his violation of probation dismissed for the sexual battery and kidnapping charge, and Walter was able to go back on probation.
Ten years ago, Walter was arrested and charged with Sexual Battery and Kidnapping. His case was resolved and he was sentenced to 8 years in Florida state prison and 7 years of probation.
After serving his prison sentence, Walter had been doing really well on probation until one night. He was 3 years into his probation term when he arrived home 15 minutes late for his curfew. For being just 15 minutes late, the police arrested Walter for violating his probation and sent him to jail.
Because Walter was previously convicted of a felony and was a registered sex offender, he was scared that this violation would send him back to prison.
He was looking at a possible life-long prison sentence in Florida state prison. Walter was also struggling with severe depression ever since he got out of prison. It was hard for him to get a job as a registered sex offender and as someone who was convicted of a felony.
Despite these difficulties, Walter was starting to turn his life around and had plans to move to a country where he would have more opportunities for success. Walter was terrified this mistake of violating his probation could ruin his future, his life and send him back to prison for a long time.
We had previously worked with Walter’s sister, so when Walter was arrested for violating his probation she called Rossen Law Firm right away.
We got to work and focused on bypassing the judge and working directly with the prosecutor, as she agreed that Walter’s mistake was not incredibly serious – certainly not worth someone being sent to jail for life over being 15 minutes late. After aggressively pushing forward, we were able to get the warrant for Walter’s arrest dismissed, which helped get him out of jail, get back on track and we got the violation of probation fully dismissed so he didn’t have to go to prison.
