Joseph had a reason and a purpose for following the firefighter, as the case for his assault charge against him was still open, and he did not want to be accused of stalking.
After Joseph’s charge of assault on a firefighter, he spent the next couple of months following around the man, the firefighter, he fought with. Joseph began to drive around Boynton Beach to see if there were any ambulances deployed, as well as showing up at the fire station and asking for his schedule. Because of this, the firefighter filed a restraining order against Joseph for stalking.
For a restraining order to be based upon stalking, the prosecutors would have to prove harassment with no legitimate purpose. We used the fact that Joseph wanted to collect information, interview people, and get character witnesses in order to defend himself to prove that he had a legitimate reason for tracking down the firefighter.
