We got the patient brokering charge reduced to a misdemeanor of uttering a forged instrument; and got the insurance fraud charge completely dropped in South Florida. Our client, Adam B., got a withhold of adjudication and spent only 12 months on probation instead of a potential of 20 YEARS in prison for his alleged crimes of patient brokering and Insurance fraud.
Patient brokering has a 2 year mandatory minimum prison sentence in the state of Florida, and Adam was scared of spending 2 to 20 years in prison. Adam also did not want to be away from his family for that long; especially when he was not even financially benefiting from the scheme.
Adam was recruited by one of his friends from his church who was a chiropractor to get involved in a fake crash scheme. Adam’s job in the patient brokering scheme was to help locate people to join in on the scheme as patients of the South Florida Chiropractor, then his chiropractor friend would report the crashes to the insurance company to get money.
When the insurance company got suspicious and went to the police, Adam was arrested and charged with patient brokering and insurance fraud.
We were able to get the insurance fraud charges dismissed immediately since Adam was not involved in the actual reporting of the car crash. We made sure Adam cooperated fully with the investigation and explained to the prosecutor how Adam was taken advantage of by the church member and he was only the middle man and was not making any money.
