William was driving down Florida State Road 84 when he was pulled over by Officer Poherence of the Fort Lauderdale police department for driving in the wrong lane. Rather than simply issuing a ticket for such, Poherence held William on the scene until he was able to get a DUI unit to arrive. Sgt. Bohm of the FLPD DUI Task Force would later charge William with a DUI. Fortunately for William, however, Rossen Law Firm was able to get his DUI charge dropped.
William was extremely rattled during his entire encounter with the Fort Lauderdale Police. Not only did he have to deal with anxieties of accidentally facing the wrong way of traffic, but he also had the misfortune of having to endure the harsh treatment of Officer Poherence, an officer with a long history of violent arrests, particularly against African Americans. Officer Poherence would later be charged with assault on a non-violent Black Lives Matter protestor in a situation that occured after the resolution of William’s case.
William was driving down Florida State Road 84 in the wrong lane. He was soon after redirected by Officer Poherence, who blockaded the area so that the readjustment could be made. Officer Poherence took things a step further by forcing William to remain on the scene until a DUI unit could arrive. That DUI Task Force officer, Sgt. Bohm, then compelled William to perform a variety of Field Sobriety Exercises, and then arrested him soon after on DUI charge.
William contacted the DUI Lawyers at the Rossen Law Firm in Fort Lauderdale to represent him. The strategy for challenging William’s drunk driving charge focused heavily on the behavior of both officers. Officer Poherence did not have the requisite proof of alcohol impairment needed to lawfully hold William on the scene. This in turn meant that Sgt. Bohm lacked the requisite proof needed to conduct his DUI investigation. On top of all of those factors, William was essentially told that he was required to perform voluntary exercises. These red flags in the officer’s investigation were all that was needed to convince state prosecutors that Williams drinking and driving charge should be dropped.
