The felony criminal mischief charge Elisa G. received in Lauderdale-by-the-Sea was completely dismissed within a month due to Rossen Law Firm’s swift action.
Elisa is a 63-year-old fiery Italian, and she does not put up with anybody’s B.S. Elisa knew that she was in the wrong, but she was worried about a criminal record, and also worried about paying the bill for the damages to the car.
Elisa lives in a condo in Lauderdale-by-the-Sea, and she rides her bike everywhere.
There is a rude, pretentious woman who lives in her neighborhood who parks her Maserati in an end spot at an angle in the parking lot. When she does this, her car blocks the storage unit for bikes.
Elisa got frustrated one day and had enough. She aggressively opened the door to the bike storage area. The door swung open to hit the car. Then, Elisa repeated this action multiple times.
Afterwards, Elisa casually put her bike away and walked home. Elisa was confronted by the police two days later, it was all caught on camera. She admitted everything to the police. Because the damages cost more than $1,000, Elisa was arrested and charged with a felony. When it comes to criminal mischief charges, the cost of the damage is what determines if the charge is a misdemeanor or a felony.
We worked through the pre-filling stage with a case filer who was very receptive.
We tried to get the charges dropped right away without making Elisa pay for the damages, but there was surveillance video showing that her actions were intentional (as she allowed the storage door to hit the car multiple times).
The case filer said that if she paid the money in damages, he would not file the felony charge. The woman who owned the Maserati was extremely difficult and insisted on getting not only the cost of the damages, but also wanted to receive the diminished value of the vehicle. She made Elisa pay $18,500.
We worked with Elisa to explain that it would be in her best interests to pay the woman, unfortunately, and walk away without any criminal charges. Because Elisa took our advice, she avoided ever getting a felony charge on her record at all.
