Kyle went from facing up to 15 years in Florida State Prison to a complete dismissal of his case. Kyle is now in the process of expunging his record & obtaining his degree.
Kyle was worried that this one mistake would follow him for the rest of his life on his record and affect his education, ability to get a job, get an apartment, and much more. He was also afraid of the ramifications since he was the only ‘adult’ found trespassing.
Our client, Kyle, was already accepted to a college when the situation took place. Kyle’s long-time childhood friend, Joe, wanted to hang out before the two parted ways for college. Kyle went over to his friend’s house like he’s done for years; only this time, Joe had some other friends over that Kyle had never met before. Joe and his friends had plans to head into an abandoned mansion and hang-out inside. Kyle was apprehensive and was visibly scared. After some peer pressure and Joe assuring Kyle that they’ve done it a million times without issue – Kyle hopped into the car with them. Once at the house, it was apparent that the house was indeed abandoned. There was graffiti all over, windows busted out, and doors off their hinges. After 10 minutes, it happened. The sound of sirens rang loud and red/blue lights lit up the inside of the house. The boys didn’t run and walked outside with their hands up. The officers placed each of the boys under temporary arrest. Kyle was the only 18 year old, which means he was treated like an adult, and the other boys were 17, which means they were treated as juveniles. Kyle had no prior criminal history, but nevertheless, the police officer on-scene arrested him for a 2nd Degree Felony of Burglary of an Unoccupied Dwelling. Kyle spent the night in the Broward County Main Jail in Fort Lauderdale. After his parents were notified of the arrest, they contacted us, The Rossen Law Firm.
