The Rossen Law Firm got John F.’s aggravated assault with a firearm charge dismissed and reduced to a misdemeanor battery. Instead of facing 3 to 5 years of prison, John was able to do probation and stay at home.
Only 18 years old, John was scared about going to prison. At the time there was a mandatory minimum for the charge – 3 years in prison. He was nervous he might spend at least 3 years in prison.
John was talking to a couple other guys in his neighborhood when they started to argue about his girlfriend. After minutes of fighting, John got upset and decided to go home and get his gun.
John drove back over to his neighbor’s house to find the men working on a car in their garage. John started to threaten them and, in an attempt to scare them, he pulled out his gun and racked it.
John did not point it at them, but he told them that he would hurt them if they didn’t stop messing with his girl. When he was done yelling, John got back in his car and left. After he left, the men called the police who came and arrested John for aggravated assault with a firearm.
John called the Rossen Law Firm right away and we were able to get him a reasonable bond and get him out of jail. Since we started working on the case early, we got the 911 call records. The call told a bit of a different story than what was told to the police, as it sounded like the men were not scared of John and were angry that he yelled at them. We did a little background research on the men John fought with and found out that they were not the best group of people themselves.
We decided to take depositions, or interviews, of the men and they ended up recanting much of what they told the police. We were able to take this to the prosecutors and push the case forward aggressively to get charges dismissed and reduced.
