Tyler was accused of committing date rape in Palm Beach, Florida. Rossen Law Firm was able to prove the date rape accusation was false while police were still doing the investigation. One day, Tyler and his roommate invited three girls to go clubbing with them in Palm Beach, Florida. They took a bus from Tyler’s apartment to the club.
While on the bus, Tyler and one of the girls began flirting and making out. Both of them began heavily drinking. At the club, Tyler and the girl continued to spend time together, and continued making out.
When they all left the club, all three women returned to the apartment with Tyler and his roommate. Tyler and the girl he had been involved with all night at the club went into his room and began to have sex.
While they were having sex, the girl freaked out, called an Uber and left.
The next day Tyler received a call from the police, questioning him about the incident. Immediately, Tyler called our office and hired us to defend his rights and relay the truth of the situation.
Tyler was a junior in college, and was worried about the incident affecting the rest of his life.
Being accused of date rape is an extremely serious offense, and Tyler was scared of being branded as a rapist and going to jail for a crime he did not commit. He was sure what was happening was consensual.
Tyler was also worried the police would automatically believe the girl, as she was the “victim” of the case and the one making the rape allegations against him.
We wanted to make sure that the police knew that Tyler had nothing to hide, so we set up a meeting with him and the detective assigned to the case.
Tyler was able to explain what happened and look the officer in the eyes, something that he would not have done if he was guilty. We also took statements from Tyler’s roommate and the other two girls they were with, who agreed the alleged victim was all over Tyler all night and seemed to be trying to progress their involvement.
The girl had also sent a text message to her friend after the incident saying that she freaked out, which helped us show that the woman was feeling frazzled and might have reacted to accuse Tyler of rape in response to not feeling stable.
