We were able to get Rachel’s charges reduced to a reckless driving charge.
Rachel is 24 years old, and is a recent college graduate. Rachel was scared that the arrest would hinder her future career, and was even more terrified of going to jail. When she was first arrested Rachel had a different lawyer, but he never responded to their calls and was very uncommunicative. After their miserable experience and determining that he did not have their best interests at heart, Rachel fired him and hired us instead.
Rachel B. was driving home from dinner with her friends when she gently rear ended a police car that was parked on the side of the road in Boca Raton, Florida. Rachel did not cause any damage, but the police officer instead placed her under investigation for driving under the influence. The police officer asked Rachel if she would complete the standard field sobriety tests, in which she agreed. Rachel was extremely apologetic on the scene of the accident, and wanted the officer to know that she did not mean to hit his car. Rachel completed the horizontal gaze nystagmus, walk and turn, one leg stand, finger to nose, and Romberg alphabet, asking him multiple questions to make sure that she completed the exercises correctly. Rachel was arrested and was taken to the Boca Raton Police Department, where she was asked if she would submit to a Breathalyzer test. After agreeing, Rachel blew both just over and under .20. Rachel was then charged with Driving Under the Influence.
Rachel enrolled in DUI school within two days of her arrest, so we played up the fact that she wanted to correct her terrible situation. We also had Rachel complete treatment, which she did right away and ahead of schedule. We used this timeline to create a mitigation packet for the prosecutors, detailing her quick involvement in working to better herself.
