Because the restraining order was a temporary injunction, we were able to get it dismissed after six months.
Luis was in the military, and has never been arrested before. Luis was worried that this dispute would affect his reputation, and did not want it to hinder his chance of getting his masters. Luis also wanted to make sure that he would be able to see his 16 year old daughter, and that she would not get involved in the divorce.
Luis S. was going through a divorce with his wife when they started arguing over paperwork. They both began yelling at each other and arguing back and forth, with Luis telling his wife not to touch his stuff. The fight began to escalate, and Luis ended up headbutting his wife. At this point their child called the police, in which they showed up while they were still arguing. The police decided to arrest Luis for domestic battery, and his wife filed a restraining order against him.
We had Luis move out of the house, to give him a cooling off period of six months. We were also able to get Luis permission to see his daughter, as there had been problems with the divorce.
