On the day of trial, we managed to get the domestic violence charge against Boris dismissed.
Boris was concerned about having a criminal record, and also whether this would affect his immigration status, and more importantly, whether it would make him deportable.
Boris B. and his girlfriend of 3 years lived together in Oakland Park, Florida one day were having an argument when he threw a watch at her. The watch hit her, leaving a small cut on her arm. The police were called, and Boris was arrested on domestic violence battery charges. The couple has a 1 and a half year old son together, and the girlfriend decided she did not want to proceed with the case against him.
The alleged victim did not want to proceed with the case and completed a waiver of prosecution. The prosecutor still didn’t want to drop the case and tried to use the 911 call against Boris, but it was deemed inadmissible.
