Client Concerns about Disorderly Conduct & Resisting Arrest Charge:
Marsha felt like she was a victim of racial profiling. She had never been arrested before and was afraid of having a criminal record, and that the incident would harm her husband’s business and their reputation in the community.
It was nighttime and Marsha C. was on her way home in her beautiful Mercedes when a cop started following her. Marsha pulled over even though she was only about one block from her home. The cop got out of the car and immediately started giving Marsha attitude for not pulling over soon enough and failing to maintain a single lane. A neighbor came out to see what was going on and the cop ignored him. He then arrested Marsha on charges of disorderly conduct. In the police report, the cop stated that Marsha was yelling, and refusing to follow his commands, and that her yelling woke up her neighbor (which is why he arrested her for disorderly conduct).
We tracked down the neighbor to get his side of the story. When we showed him the cop’s police report he told us that it was completely false. He was already awake playing video games and came outside to see what was going on because he heard the cop yelling and screaming at Marsha. We then ran an internal affairs report on the cop and found that he had been found guilty of attacking a civilian at a gas station and was on a Last Chance Agreement with the police department which stipulated that if he got caught doing anything bad again he would be fired.
