Scott had a light criminal history and was not a violent offender, so he did not want this incident to ruin his future. More importantly, Scott did not want to be branded as a thief.
Scott R. was shopping when he was seen putting items into his bag throughout the store. The security guard watched Scott walk past the cash register and leave. Outside, Scott was stopped and brought into the store’s office, where the items were recovered from his bag. He was not arrested, but the store filled out an affidavit with the intent to prosecute.
Scott moved to South Florida from Virginia to enter a treatment program for his drug addiction, which we used to our advantage throughout his case. The case was filed by the city of Ft. Lauderdale, whose prosecutors we have a good relationship with. We negotiated with the prosecutors about how Scott has been trying to better himself, showing letters from his treatment facility of the programs and classes that he has been a part of. We have also represented Scott before, and were able to get him to fill out all of the necessary paperwork on time.
