Kern’s charges were dropped within a month of his arrest.
Because Kern was charged with a felony, he was worried about receiving the recommended sentence of life in prison. Because of this possibility of life in prison, he was not supposed to get a bond for the case. Kern was worried that he would have to wait years in jail for the case to be resolved. Kern was also concerned about being labeled as a violent felon
Kern E. heard that his ex-girlfriend had a new boyfriend and went over to her house to confront her. Once inside, the two began arguing and their fight got physical, with the ex-girlfriend being scratched on the shoulder. A witness that was inside of the ex-girlfriends house at the time called the cops to have Kern arrested. He was taken to jail and charged with Burglary with a Battery. Since we have known Kern’s mom for the last five years, she called us immediately after the arrest on a Friday right before the end of the week.
We showed up to Kern’s first appearance on Saturday morning, the day after he called, as the arrest was for a serious felony. We had the ex-girlfriend testify that Kern had permission to be in her house, and that they were both at fault for the fight. The ex-girlfriend also admitted that the cops on the scene pressured her to make a statement. Because of this, the judge gave Kern a $1500 bond. We also had her sign a waiver of prosecution, which we used in negotiations with the prosecutors
