A high-level bank executive, Moshe was concerned about the DUI threatening his job.
Moshe K. was driving home from a business function when he slammed his Mercedes into the back of a Chrysler sedan, which then ran into the Ford in front of it. This happened at a red light. There was $36,000 worth of damage between the 3 vehicles. When the cops came they claimed they smelled alcohol and started doing a DUI investigation on Moshe. In the police report the cops claimed that he was off balance, his eyes were glossy, and that he was slurring his words. The cops tried to get Moshe to do the field sobriety exercise, but after completing the first one he refused to do any of the others. The cops then arrested him for DUI.
The video footage completely contradicted what was in the police report. Moshe was speaking clearly, sounded intelligent, was not slurring and had an intelligent conversation with the officers. We even got the breath technician to admit she was unable to determine whether he was impaired.
