Martin was afraid of having a criminal record after being victimized. He was also afraid of filing any complaints against these cops because they patrol his neighborhood in Plantation, Florida and he was afraid of retaliation.
Martin is a 50 year-old nurse. One day he picked his daughter up from school and on the drive home he found out that the road leading to his house was completely shut down due to a huge accident. He parked the car and started walking home with his daughter, which led him by the scene of the accident. Martin stopped behind the crime scene tape to see if he could help in any way with his medical skills. A police Sergeant started screaming at him to get out of the crime scene. Martin told him that he was a nurse and could possibly help, but the cop started screaming at him even more. Martin informed the cop that he was on the other side of the police tape, meaning he was not illegally trespassing onto the scene of the crime. The cop got angry and called for backup. Four cops rushed Martin, threw him to the ground, and attacked him all while screaming “stop resisting arrest!” Then they tased him three times, to the point where he urinated himself. They then handcuffed him so tightly that Martin had no feeling in his hands for months after this incident. His daughter unfortunately witnessed the entire scene and needed therapy.
We pulled internal affairs records on all of these cops and every single one of them had multiple incidents on their record, which we brought up during depositions.
