The State dismissed Joseph G.’s charge of assault on a firefighter in Boynton Beach, Florida.
Joseph was scared. The incident started just because Joseph was trying to help an elderly man. He did not want to cause any trouble. He did not want think his intentions to be a Good Samaritan would be used against him in court.
Joseph was driving near a nursing home in Boynton Beach when he saw an elderly man fall outside. Joseph pulled over and tried to help and assist the man. He called 911. When fire rescue arrived, they tried to make Joseph leave. Joseph didn’t believe fire rescue were helping the man as they should. He started yelling at the firefighters and things escalated so much that Joseph told a firefighter that he would beat him up. Fire rescue called the police, who arrived and then arrested Joseph for assault on a firefighter.
We were able to get personnel records on the firefighter which showed that previously he was disciplined and suspended for lying about crashing a fire vehicle and covering it up. We were able to use that information to portray the fire fighter as someone who was dishonest and didn’t have credibility. We got the case dismissed and spared Joseph from consequences ranging from a fine of $500 to 60 days in jail.
