We were able to reduce Maliq’s felony charge of Aggravated Fleeing and Eluding to a misdemeanor for resisting arrest. Instead of going to jail and becoming a convicted felon, Maliq was put on probation for six months with the requirements of attending aggressive driving school and completing community service.
Because Maliq fled from the officer, the punishment resulting from a guilty verdict at trial would be a mandatory conviction and a 1 year driver’s license suspension. This worried Maliq, as he would become a convicted felon for a simple misunderstanding.
Maliq E. was driving in North Lauderdale one night going 45 miles per hour in a 35 miles per hour zone. The officer did not stop Maliq until he made a right turn on red without slowing down, as no cars were approaching in Maliq’s direction. Maliq pulled over and waited for the officer to get out of his vehicle and talk to him, but the officer stayed in his vehicle and did not signal that Maliq was in trouble. Just as the officer was just getting out of his vehicle, Maliq drove away because the officer had made no indication that he would speak to or arrest Maliq. The police department identified and arrived at the home of Maliq’s mother, Annette, as the vehicle was registered in her name. She called Maliq and he indicated that he had stopped for the police, but left when they did not take any action. The officers located and arrested Maliq, and he was charged with a felony for fleeing and eluding the police.
