This 22-year-old nursing student was charged with DUI Enhanced after being pulled over for speeding. Her ex-boyfriend, who was sober, made her drive drunk, putting her in an incredibly vulnerable position. Despite this, she remained cooperative and polite with law enforcement throughout the investigation.
Due to her high breathalyzer results, she was not initially eligible for the DUI diversion program. However, Scott Simmons and our team saw the potential for a different resolution. We highlighted her excellent character, her commitment to rehabilitation, and several legal inconsistencies in the case. We filed a Motion to Suppress to suppress the Blood Sample as the policy and procedures were not properly followed.
Scott’s efforts paid off. The DUI charges were dismissed, and her charge was reduced to reckless driving with a withhold of adjudication. This resolution means she can seal the case off her record, preserving her future as a nurse. She resolved her case to a resolution that was ultimately better than the DUI Diversion Program.
