The day of trial the prosecutors finally folded and offered us the reckless driving charge, which we took.
Enrique was afraid of losing his license, going to jail, and having a criminal record on top of the break up with his girlfriend.
Enrique P. is the manager of a sporting goods store. After a bad break up with his girlfriend, Enrique went to RoundUp in Davie, Florida and drowned his sorrows with a few beers. Still upset, he then decided to hit Taco Bell, and took a back road to get there. There was a cop on the back road who claimed he was swerving, and that at one point another car had to swerve to avoid hitting Enrique’s car. The cop then pulled him over and called a DUI investigator. Enrique consented to the field sobriety exercises, which the cop wrote that he failed. He was then arrested for DUI and refused the breath test.
Enrique wasn’t slurring and performed the field sobriety exercises fairly well. He did admit to drinking 4 or 5 beers, but he wasn’t drunk and didn’t cause any accidents, so we tried to convince the prosecutor to reduce the charges.
