Dwayne is in grad school, and did not want this incident to ruin his ability to graduate and future career. He has never been arrested, and did not want the embarrassment of a mugshot and arrest. The charges, if brought against him, were felonies, which were punishable by up to 15 years in prison.
Dwayne P. and his girlfriend of three years were together in their house when they became involved in a verbal argument about infidelity. The fight got physical, with both parties attacking the other. At one point during the argument Dwayne pulled out a firearm, at which his girlfriend left their house for the night. The police arrived the next morning and questioned the girlfriend, who was still upset from the night before. Dwayne wasn’t home and the police never attempted to get his side of the story.

We convinced the police to send the incident to the State Attorney’s Office and stop looking for Dwayne, making sure that he was not arrested. We had his girlfriend, who did not want to press charges, come into the office and write a waiver of prosecution, detailing how she was throwing household objects at him and she was the aggressor.
