After numerous attempts at negotiating with the prosecutors, we were finally able to get the DUI charge reduced to reckless driving. Felipe was very happy as this meant no jail time and no 5-year suspension of his license.
This was Felipe’s second DUI arrest within 5 years, so he was worried about jail time and a 5-year suspension of his driver’s license.
The police officer was on a DUI saturation patrol (meaning he was specifically driving around for the purpose of finding people to arrest for DUI) in Pompano Beach when he stopped Felipe. The officer made Felipe A. do a series of field sobriety exercises, which he noted in his report that Felipe failed miserably. The field exercises were not on video. The officer arrested Felipe and took him to a BAT facility where Felipe was put on video to take a breathalyzer test.
Strategy of Attack on Pompano Beach DUI Case:
Once we gathered all of the evidence, including the video from the BAT facility, it contradicted the police officer’s account in his police report that Felipe was impaired. On video at the BAT facility Felipe looked very sober and did the field sobriety exercises much better than indicated in the officer’s report.
