Avoiding Prison Time in a Complex Burglary & Sex Crime Case

In a recent case handled by Attorney Scott Simmons of Rossen Law Firm, our client was charged with burglary of a dwelling, voyeurism, and indecent exposure. Burglary is defined as unlawfully entering someone’s property (a dwelling or home) with the intent to commit a crime. A dwelling includes the house itself and surrounding areas like a porch or patio, legally referred to as “curtilage.” This was a key factor because the client had entered the patio area of the victim’s home, leading to the burglary charge.

Our client was initially accused of felony burglary, plus misdemeanors of voyeurism and indecent exposure, both serious charges in Florida. Voyeurism is when someone invades another’s privacy for sexual gratification, while indecent exposure involves exposing sexual organs in a public place. The client was seen on camera looking into the victim’s window and exposing himself for a brief moment.

Our defense strategy included challenging the evidence and creating a solid mitigation package to avoid harsh penalties. A mitigation package is a collection of information and actions that aim to reduce the severity of the legal consequences for the defendant. We arranged for a psychosexual evaluation for our client, which showed a low risk of reoffending. With additional therapy and cooperation, we presented the case to the state attorney, arguing that our client was not a threat to the community and had taken responsibility for his actions.

Initially facing a felony burglary charge, which under Florida law can lead to mandatory prison time of up to 15 years (21 months, in this case), we were able to negotiate a plea deal. The felony charge was reduced to a misdemeanor trespassing, and the client received 12 months of probation for each misdemeanor charge (voyeurism and indecent exposure). Thanks to our proactive defense, the client avoided jail time, and the probation terms will likely end sooner through early termination.
